Statement by Gov. Perdue Regarding Legislative Action
 
RALEIGH – The Republican-controlled General Assembly conducted a legislative session last night and early this morning that violated the North Carolina Constitution. Gov. Perdue had reconvened the General Assembly pursuant to Article II, Section 22(7) of the North Carolina Constitution solely to consider her veto of Senate Bill 9.
 
Article III, Sec. 5 of the North Carolina Constitution states that at sessions reconvened pursuant to Article II, Section 22(7), “the General Assembly may only consider such bills as were returned by the Governor to that reconvened session for reconsideration.” Therefore, in considering anything other than Senate Bill 9, the General Assembly violated the North Carolina Constitution.
 
Gov. Perdue issued the following statement:
 
“The Republicans in the General Assembly didn’t have the votes to get what they wanted legally. So, in the dark of night, they engaged in an unprecedented, unconstitutional power grab. I am saddened for the people of North Carolina that the Republicans abused their power and chose this destructive path.”
